Employment is "At Will".  I agree that if I am made an offer of employment with Recology or its related companies ("Recology"), the employment relationship will be terminable at will by either Recology or me, with or without notice or cause. I further understand that no employee or officer of Recology other than the Chief Executive Officer has the authority to modify this at-will nature of the employment relationship. This relationship can be modified only by a written agreement so providing and signed by the Chief Executive Officer and me.

Agreement to Arbitrate.  Recology or its related companies ("Recology") and I agree that in consideration for my submission and Recology's acceptance of this application for employment, Recology and I will resolve any and all claims, disputes, or controversies arising out of or relating to my application or candidacy for employment with Recology, or any claims, disputes, or controversies arising out of or relating to my subsequent employment with Recology, if any, or termination from such employment, exclusively by final and binding arbitration before a neutral arbitrator.  All such claims and this agreement to arbitrate shall be governed by the Federal Arbitration Act, 9 U.S.C. Sections 1-16.  By way of example only, such claims include claims under federal, state, and local statutory or common law, such as the Age Discrimination in Employment Act, Title VII of the Civil Rights Act of 1964, as amended, including the amendments of the Civil Rights Act of 1991, the Americans with Disabilities Act, unfair competition and unfair trade practices laws, the law of contract and the law of tort.  There shall be no right or authority for any dispute to be heard or arbitrated on a class action basis, as a private attorney general, or on a basis involving disputes brought in a purported representative capacity on behalf of the general public, any other applicants for employment with Recology, any other employees of Recology, or other persons similarly situated; provided, however, that any individual claim of the undersigned applicant or Recology is subject to this agreement to arbitrate.  Recology's current Arbitration Policy, applicable to its employees and to you, if you are hired, is available for your review upon request. I further understand and agree that Recology's acceptance of this application for employment does not obligate Recology to offer me employment.
